Terms of Service

These Terms of Service ("Terms") govern your use of the CMO In Your Pocket ("CMOP") platform, operated by RKPROD, a company registered in France. By accessing or using CMOP, you agree to be bound by these Terms.

1. Definitions

  • "Service" refers to the CMOP web application and all associated features.
  • "User", "you" refers to any individual or entity using the Service.
  • "Content" refers to data, text, documents, and other materials available through the Service.

2. Account Registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must be at least 16 years old to create an account.
  • One person or entity may not maintain more than one free account.

3. Subscriptions & Billing

  • CMOP offers Free, Pro (€79/month), and Ultra (€199/month) plans.
  • Annual billing is available at a discounted rate (Pro: €69/mo, Ultra: €179/mo).
  • Payments are processed securely by Stripe. All prices are in Euros and exclusive of applicable taxes.
  • Subscriptions renew automatically. You may cancel at any time from your account settings.
  • Upon cancellation, you retain access until the end of your current billing period.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge to request a refund.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Scrape, crawl, or use automated means to extract data beyond what the Service provides.
  • Redistribute, resell, or sublicense access to the Service without written permission.
  • Upload malicious files, malware, or content that infringes third-party rights.
  • Interfere with the Service's performance or other users' access.

5. Intellectual Property

  • The CMOP platform, including its design, code, and brand, is the property of RKPROD.
  • Data sourced from third-party databases (USPTO, EPO, FDA, PubMed, etc.) is subject to the respective licenses and terms of those sources.
  • AI-generated summaries and enrichments are provided for informational purposes and should not be considered legal, medical, or regulatory advice.
  • You retain ownership of any documents you upload. By uploading, you grant us a limited license to process them for the purpose of providing the Service.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

  • The Service will be uninterrupted, timely, or error-free.
  • Data from third-party sources is complete, accurate, or up-to-date.
  • AI-generated content is free from errors or omissions.

8. Limitation of Liability

To the maximum extent permitted by law, RKPROD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

  • You may close your account at any time from account settings or by emailing us.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your data will be deleted within 30 days, subject to legal retention obligations.

10. Modifications

We reserve the right to modify these Terms. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of France. Any disputes shall be submitted to the competent courts of Paris, France.
